Terms of Use

Welcome to the Supermoms club. It is an online resource aimed at easing women’s life, finding new girlfriends, and expanding informational horizons. Supermoms club is a network resource that unites women who are planning pregnancies, are pregnant or have already become mothers. By creating personal account or using the Supermoms club other way, you are agreeing to be bound legally by these terms. If you do not agree to be bound by these terms, you are not entitled to use the services.

1.GENERAL TERMS

1.1. The following terms and definitions are used in this document, and shall be comprehended equally for arising out or relating to the agreement Parties:

1.1.1. Agreement – present User Agreement.

1.1.2. Service — a set of services and a license provided to the User.

1.1.3. Application - the Supermoms club application for Android and IOS mobile operating systems.

1.1.4. User – a legally capable natural person who has duly acceded to this Agreement to use the Application.

1.1.5. The copyright holder of the Supermoms club — “Nobel Engineering Co.” LLP, established under the laws of the Republic of Kazakhstan and located at 34 Koshkarbayev Street, apt. 79, Nur Sultan.

1.1.6. Content – design elements, illustrations, graphics, photographs, scripts, texts, videos, music, sounds and other objects placed in application, which are intellectual property, whose license to use may belong to Supermoms club, User or other persons.

1.2. Supermoms club reserves the right to update and change the Terms of Service without notice. Any new features aimed at expanding or improving the current services, including the release of new tools and resources, are subject to this Agreement. By keep using Service after any changes provided, the User hereby agrees to amended User Agreement.

1.3. You are entitled to use Service in any way of any kind within its declared functional capabilities, including:

• Viewing content posted on Supermoms club.
• Registration and/or authorization on Supermoms club.
• Posting or displaying any content, including but not limited to the following: text, hyperlink, image, audio and video files, report and/or other information.

1.4. Ignorance of Terms and Conditions does not remove the obligation to comply with the rules. Using the Service means your total acceptance of the Terms and Conditions, and obligation to comply with the rules.

1.5. The User is not entitled to make unauthorized access to the Service, information-computing, or network resources of the Supermoms club.

1.6. By using the functionality of the Supermoms club, the User agrees that some information may be transferred to the Supermoms club partners solely to ensure the corresponding service provided by Supermoms club to User as well as grant the User the right to use additional functional (software) capabilities provided jointly with the following partners, and only within the allowable measure of rights envisaged by the proper provision of the following services and/or functional capabilities, including the other cases in order to perform the terms of this Agreement.

1.7. Certain services may display, include or provide content, data, information, applications and materials of third parties, or provide links to certain third party websites. By using the service, you agree that Supermoms club will not be liable for research or assessment of the content, including accuracy, completeness, timeliness, effectiveness, and copyright compliance, as well as legality, decency, quality or other aspect of such third-party materials or websites.

1.8. The User has access to the database of doctors and possibility to make an appointment with a doctor through partner service - Doq.kz, or directly via Application. Supermoms club disclaim any responsibility for the quality of medical services provided by doctors or medical organizations, including those posted in the Application, as well as for related examinations, appointments, procedures, treatment with its direct or indirect consequences of correct or incorrect application, regardless of period since provision occurrence time.

1.9. Supermoms club will not be liable for the accuracy of information regarding licenses, certificates and other official documents of medical institutions and medical workers.

1.10. For Users with «gold», «silver», «bronze» statuses, Supermoms club provides only the opportunity to use a special promotional code in the stores of Partners, is not a party to the Agreement concluded between users and partners, and is not responsible for the actions of partners. Promotional code – alphabetic code that represents a discount for a specific group of Products. The discount is activated by a promotional code, being valid upon purchase. The promotional code shall be presented in the Partner’s store or pronounced at the store’s checkout when placing an order. Supermoms club is not liable for the quality of services provided by Partners.

2. TERMS OF SERVICE

2.1 The service is intended for persons over the age of 18. By using the Service, you declare and confirm that you are at least 18 years of age and that you have right to perform actions without the need for any contractual approvals or consents;

2.2 Only female users have access to the service. By using the Service, you declare and warrant that your gender is female and that you are ready to provide additional information to verify your identity at the request of the Service. The exception is profiles registered on the Service as Doctors or Doles;

2.3. Only registered Users are permitted to have a full access to the Service, create a User profile, post Information, familiarize with more complete information about other users, and send messages;

2.4. The User agrees that the Information posted in the Application is available to other users, both directly in the Application, and by broadcasting by various technical means (via mailing campaign, RSS, embed code, etc.) with a link to the original source, in the amount of Information left by the User in the Application;

2.5. The User agrees that the Information (any part of it) with not closed or limited access is considered publicly available and does not require compliance with its non-disclosure;

2.6. Application is intended for personal non-commercial use;

2.7 The application is provided to the User for the convenience of organizing and processing information. Any information received by the User through the Application is provided solely for educational purposes and does not constitute a medical opinion, diagnosis, guide to action or treatment. . Responsibility for the use of the application lies entirely with the User, so Supermoms club does not bear any responsibility for the consequences of its use. This application is intended to be used as a guide only, and not as a substitute for the advice of your doctor or medical worker.

3. RIGHTS AND OBLIGATIONS OF THE USER

3.1. The User is obliged to properly comply with the terms of this Agreement;

3.2. The User is obliged not to use the Application for any other purpose except of related to personal non-commercial use;

3.3. The User is obliged to take appropriate measures to ensure the safety of the data stored in the account, including the password, and is personally responsible for their safety and confidentiality. If such data become known to third parties, the User is obliged to immediately change the previously indicated email address or password if there is reason to believe that his or her email address and password used to enter the website have been identified and/or can be used by third parties. The risk of adverse consequences caused by the availability of ID data to third parties lies entirely with the User;

3.4. The user assumes all possible risks related to mistakes and inaccuracies in the data provided;

3.5. The User is liable for the actions performed under his or her account and when using his or her username and password, as well as for all actions done from the user’s Mobile where the application is used. The User shall be obligated to immediately notify Supermoms club about all security incidents and unauthorized access to the account. Failure to comply with this obligation, the User is independently and fully responsible for the actions performed under his or her account. For verification purposes, the account may be subject to blocking;

3.6. The User is prohibited from using the Service for illegal activities. The User undertakes not to violate the current legislation of the Republic of Kazakhstan or the state in the territory of which he or she operates (including but not limited to copyright laws);

3.7. The user is not entitled to publish someone else's private or confidential information, or to commit any actions that violate the rights of others, including intellectual property rights. The user is not entitled to impersonate other people or provide inaccurate information;

3.8. The User is eligible to delete his or her account at any time;

4. RIGHTS AND OBLIGATIONS OF SUPERMOMS CLUB

4.1. Supermoms club is eligible to block the User’s access to the Application in case of violations of User’s obligations specified in section 5 herein;

4.2. Supermoms club is eligible to rescind the Agreement for organizational or technical reasons unilaterally, blocking the possibility of its use;

4.3. Supermoms club is eligible to remove any content or information that you share on the Service if it violates this Agreement;

4.4. To improve and increase the stability of the Application, Supermoms club is eligible to collect, store, and process statistical information about the use of the Application by the User;

4.5. Supermoms club is eligible to contact the User, including sending information messages to the mail address specified during registration, as well as sending messages to the User’s mobile phone.

5. RIGHTS AND OBLIGATIONS OF THE DOCTOR

5.1. The Doctor is eligible to request from User the information necessary for the provision of the Services;

5.2. The Doctor is eligible to view statistics on the amount of services provided by Consultants in your personal account (the number of consultations for the period/ in the context of consultants/ the number of open and completed consultations/ the cost of services provided for the period, etc.);

5.3. The Doctor is eligible to fulfill the obligations assumed properly and within the time frame contained herein;

5.4. The Doctor is obliged not to disclose to third parties information that became known during the execution of the Agreement;

5.5. The Doctor is obliged not to impersonate another person and post answers that may be misleading;

5.6. The Doctor is obliged not to disclose or confirm a disease, conclude the health condition, determine the types and methods of examination, prescribe treatment and drugs, recommend the use of medical devices, determine and choose treatment tactics, predict the development of the disease and effectiveness of the chosen treatment method. If the response of the Medical Organization contains an assumption about the possible presence of a disease, the content of the response must be accompanied by information on the need for an in-person visit to a specialist (doctor);

5.7. The Doctor is obliged not to include in the responses any links to prohibited materials and/or information resources on the Internet;

5.8. The Doctor is obliged not to post advertising information in replies.

5.9. The Doctor undertakes all responsibility for the accuracy of filling in the information in his or her account. Please, bear in mind that counterfeiting, production or circulation of forged documents is punishable by law!

6. DELETING CONTENT AND DELETING THE USER ACCOUNT

Violations of the following conditions will lead to the immediate removal of the copyrighted User’s Content. The Application is prohibited from publishing information that:

• Contains threats, discredits, violates rights, insults, denigrates honor and dignity or business reputation, violates the privacy of other Users or third parties;
• Shall be considered as vulgar and obscene, contains pornographic images, text, or scenes of sexual nature involving young persons;
• Contains a description of the means and methods of suicide, including any incitement to commit it;
• Contains information that propagandizes and/or contributes to inciting racial, religious, ethnic hatred or enmity, political discord; promotes the ideology of fascism or racial superiority, contains negative statements about any country/people/religion/politics; humiliates national dignity, also based on of nationality political views;
• Contains extremist materials;
• Propagandizes criminal activity or contains tips, instructions or guidelines for committing criminal actions;
• Contains information on limited access, including but not limited to state and commercial secrets, information about the private life of third parties.

Supermoms club reserves the right, which is not an obligation, to suspend or terminate the service of the User's account if provided information is identified as illegal, offensive, pornography, slander, cover threat, include a defamatory nature, hurts the feelings of other users, and violates copyright and/or this Agreement.

7. CONFIDENTIAL PROVISIONS

The User's personal information contained in the User's account is stored and processed by Our service in accordance with the terms of the Privacy Policy posted at : Privacy Policy.
User's personal data includes: 1) username; 2) region of residence; 3) e-mail address, phone number, other contact information; 4) IP addresses, other communication data of users; 5) messages, emails transmitted from the User to others in the Supermoms club (including the Service administration).
