Да, конечно можете. Согласно пункту 4, статьи 64, Если вы с бывшим супругом не проживаете вместе, официально расторгнут брак, и ваш ребёнок живет с вами, вы можете присвоить малышке свою фамилию. И ЗАГС разрешает этот вопрос в интересах ребёнка , без учета мнения вашего бывшего мужа.
